1. Acceptance of Terms

By accessing or using InnerHaven ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

InnerHaven provides AI-powered companion services for emotional support, conversation, and creative engagement. The Service includes:

• Chat interfaces with AI companions
• Memory features for conversation continuity
• Various companion roles with different purposes
• Image sharing (vision input) within conversations
• Text-to-speech (TTS) voice playback of companion messages
• Custom companion creation and personalization
• Adult content features for age-confirmed users (18+)

3. Eligibility

• General Access: You must be at least 18 years old to use InnerHaven
• Adult Content: Age confirmation is required for adult features
• Account Responsibility: You are responsible for maintaining the security of your account

5. Acceptable Use

You agree NOT to use InnerHaven to:

• Generate, upload, or share content involving minors in any sexual, abusive, or exploitative context
• Upload images depicting the sexual exploitation or abuse of minors (CSAM)
• Create content promoting violence, terrorism, or illegal activities
• Upload images that you do not have the right to share, or that depict real individuals in compromising situations without consent
• Harass, abuse, or harm others
• Attempt to bypass safety features or content filters
• Reverse engineer, decompile, or extract source code
• Use automated systems to access the Service without permission
• Impersonate others or misrepresent your identity
• Share your account access with others

6. Adult Content

InnerHaven offers adult content features for users who confirm they are 18 or older. By accessing these features:

• You confirm you are 18 years or older (or the age of majority in your jurisdiction)
• You accept full responsibility for the content you request
• You acknowledge that adult content is AI-generated fiction; no real individuals are depicted
• You agree not to share adult content with minors

7. User-Uploaded Content

You may upload content to InnerHaven, including images shared in chat (vision input) and custom companion avatars. By uploading content, you agree that:

• You have the legal right to share the content you upload
• Uploaded images are sent to third-party AI providers for processing (see our Privacy Policy)
• We may review uploaded content for compliance with these Terms, including safety and legal obligations
• You will not upload content involving minors in any sexual or exploitative context
• Uploaded content is stored on our servers while the associated conversation or companion exists
• You may delete uploaded content by deleting the associated conversation or companion

Image sharing is not available for adult-tier companion roles. AI providers may decline to process images that violate their content policies.

8. Voice Services (Text-to-Speech)

InnerHaven offers AI-generated voice playback of companion messages. Regarding voice services:

• Voice audio is generated on-demand by third-party providers (ElevenLabs)
• Generated audio is delivered to your device but is not stored on our servers after delivery
• Your device may cache audio locally for up to 7 days (see our Cookie & Storage Policy)
• Voice time is billed based on exact audio duration
• Some message content may be declined by voice providers due to their content policies; you are not charged when voice generation is refused
• AI-generated voices do not represent real individuals

9. Content Moderation

InnerHaven uses a combination of automated systems and human review to maintain platform safety:

• AI models include built-in safety filters that may decline certain requests
• We reserve the right to review content when we have reason to believe these Terms have been violated
• Automated systems may flag content for review based on safety criteria
• Content involving the sexual exploitation of minors is subject to mandatory reporting to NCMEC and law enforcement
• Accounts found in violation may be suspended or permanently terminated at our discretion
• Moderation decisions are made in good faith to maintain platform safety and legal compliance

10. Intellectual Property

• InnerHaven and its original content are owned by Wigley Studios
• You retain ownership of content you create through the Service
• You grant us a license to use your content to provide and improve the Service
• AI-generated responses are provided "as-is" without ownership claims

11. Payment and Subscriptions

• Free tier has usage limitations as described on our pricing page
• Paid subscriptions auto-renew unless cancelled
• Cancel anytime through your account settings
• Refunds are handled per our Refund Policy within 7 days of purchase
• Chargebacks or fraudulent payment disputes may result in immediate account suspension
• Daily message allowances reset at midnight UTC and do not roll over
• Purchased packs (messages and voice) expire 12 months from the date of purchase

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the past 12 months
• Some jurisdictions do not allow certain limitations of liability; in such cases, liability is limited to the maximum extent permitted by applicable law
• We are not responsible for AI-generated content accuracy or appropriateness

14. Termination

• You may close your account at any time
• We may suspend or terminate accounts that violate these Terms
• Violations involving the sexual exploitation of minors result in immediate, permanent termination and reporting to law enforcement
• Upon termination, your right to use the Service ceases immediately
• You may request data export before voluntary account deletion

15. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new terms.

16. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in the State of Georgia, except where prohibited by applicable law. You agree to waive the right to participate in class action lawsuits or class-wide arbitration against Wigley Studios.

For claims under $10,000, arbitration may be conducted entirely online. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for matters relating to intellectual property or unauthorized access to the Service.

17. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law provisions.
